On March, 27, President Obama exercised his recess appointment powers to appoint 15 nominees to various federal positions including labor attorney Craig Becker and attorney Mark Pearce to the National Labor Relations Board (NLRB). Becker's nomination to the NLRB was opposed by Republicans, as well as a couple of Democrats, who argue he will bring bias in favor of labor unions to the position. The Senate on February 9, failed to confirm Becker's appointment to the NLRB. Becker currently serves as a lawyer for the labor organizations SEIU and AFL-CIO and has spoken favorably of the Employee Free Choice Act, a bill that would make it easier for workers to unionize.
The current Obama Administration has indicated that organized labor reform and jobs legislation is a top priority. Enforcement efforts across several government agencies, including the DOL, NLRB, and the EEOC have received significant funding increases for their 2010 budgets for audits and investigations for issues such as classification of salaried exempt and independent contractors and monitoring of overtime. Combine that with strong efforts by organized labor to pass the Employee Free Choice Act (EFCA) and the DOL launching a new public awareness campaign called "We Can Help", targeting workers' rights and pay issues, which will not only increase the number of employee complaints, it will only further strengthen the government's enforcement agenda.
